HAL HUNT ENTERPRISES, INC. dba Hal Hunt Auctions is holding a sale of antique furniture, used furniture, home furnishings, decorative items, art works, and other miscellaneous items.  The sale will be conducted as an auction by HAL HUNT AUTIONS. The auction is open to the public, but all persons wishing to participate by bidding in person, absentee bidding, phone bidding, or internet bidding to ultimately purchase any of the items available for sale must agree to, and are bound to the Terms and Conditions listed below:

   1. We have all items offered for sale available for inspection at least the day before the sale. A Preview Period will be posted prior to the Auction.  It is the sole responsibility of Buyer to carefully inspect any item he may purchase, prior to bidding on it.  ALL ITEMS ARE SOLD "AS IS" WITH NO WARRANTY OR GUARANTEE.  No statement made in any advertising, on the internet, internet descriptions, or informational materials for the auction, nor made orally before or during the auction, or on invoice is intended to be a warranty or guarantee of the age, condition, quality, provenance or origin of any item offered for sale.  ALL SALES ARE FINAL, NO REFUNDS.  Buyer accepts all responsibility for examining any item offered for sale, investigating its background and informing himself of  those matters necessary to evaluate the item as a potential purchase.  Buyer also acknowledges that HAL HUNT AUCTIONS,  the Auctioneer, and their employees have not made any representations upon which Buyer is relying. Photos and descriptions have been posted on the Internet, and we encourage prospective buyers or internet buyers to call or email for information or questions at least one day prior to the auction to gather any additional information or photos.  High and low estimates found in the Internet catalog are listed only for guide purposes only, they do not represent starting or ending bids. All measurements and weights are approximate, rounded up to the nearest inch & provided for shipping estimation purposes only, with no guarantee of accuracy.

   2.  The Auctioneer will call out each bid as he receives it.  We will not be responsible for any bid offered but not received. We will not be responsible for any failure to execute absentee, electronic or phone bids due to human error or electronic failures of any kind. The Auctioneer may pause or end the auction at any time. Any item originally offered for sale may be withdrawn from the sale at any time prior to the Auctioneer's declaration that it is sold.  Items may be added to the sale at any time.    The auctioneer will, without liability, determine the bidding increments and maintains sole authority to resolve disputes. The auctioneer reserves the right to reject a bid from any bidder. A lot will be sold to the highest bidder as determined in the sole and exclusive judgment of the auctioneer.  A reserve is the confidential minimum price established between Hal Hunt Auctions and the consignor.  Lots may be auctioned with reserve, and auctioneer may advance the bidding on behalf of the seller's reserve without further notice. Neither Consignors nor their agents, except as in the preceding sentence, are allowed to bid on their own items.

 
   3. Bidding: In-Person Bidding will be available for all scheduled Auctions. Absentee Bids are accepted at all scheduled Auctions but must be submitted no later than 6pm the day before the Auction. Phone Bids may be accepted on select items at the sole discretion of Hal Hunt Auctions must be arranged by 6pm the day before the Auction. Only our select Auctions identified as Hal Hunt Auctions – 301 will be available for online bidding at Hal Hunt Auctions on Live Auctioneers. All online bidders must register to participate.

   4. Internet Bidders:  To bid you must register online by clicking on the link on our website or go Live Auctioneers and enter Hal Hunt Auctions. The sales price will include a 25% Buyer's Premium added to the final bid accepted by the Auctioneer.  All internet purchases must be paid for through LivePay through Live Auctioneers. You will receive your invoice within 24 hours. If you do not make payment through LivePay within 72 hours your credit card on file will be charged. Live Auctioneers Credit Card fee will be applied to your invoice. Purchases through the internet are subject to Sales Tax which is based on your shipping address. The sales tax will be on your invoice and collected by Live Auctioneers. If you are tax exempt you must submit your tax exemption certificate to Live Auctioneers prior to the auction.  Packing, handling and shipping of purchased lots is the sole responsibility and strictly at the option of the purchaser. We do not provide storing, packing, loading, or transporting services. The buyer must have all items removed within 30 days of the auction, beyond that there will be a storage fee of $25.00 a day per item. Internet Buyers have 3 options for shipping, see below:

      4a. LiveShipping through Live Auctioneers:  Shipping cost will be determined based on the size of the purchase and then added to your invoice and is handled through Live Auctioneers through their LiveShipping. The shipping cost is based on the zip code you provided, based on the estimated size and weight of the item you purchased. The cost includes item pickup, packing, shipping, delivery and insurance. It is the buyer’s responsibility to follow up with LiveShipping to confirm pickup and delivery schedule.

      4b.  Buyer Arranged Shipping: Buyer agrees and is responsible for contacting and arranging for the pickup, packing, and shipping of all items purchased. Buyer must contact Hal Hunt Auctions within 7 days of purchase with Shipping Arrangements. The buyer must have all items removed within 30 days of the auction, beyond that there will be a storage fee of $25.00 a day per item.  Hal Hunt Auctions nor any of its employees shall be responsible in any manner for any type of damages caused, as a whole or in part, by the packing, loading or transporting of any item once it has been purchased by Buyer.  A list of shippers can be found on our website.

      4c.  Local Pick up: Buyer can pick up purchased items during normal business hours. Hal Hunt Auctions nor any of its employees shall be responsible in any manner for any type of damages caused, as a whole or in part, by the packing, loading or transporting of any item once it has been purchased by Buyer.

 

   5. In House Bidders Only (in person, absentee, or phone): In Person Bidders must register with the cashier, execute the Buyer Registration Contract, and obtain a Bid Card Number. Absentee Bidders and Phone Bidders must be pre-registered  with the Buyer Registration Contract and be approved by Hal Hunt Auctions. The sales price will include a 20% Buyer's Premium added to the final bid accepted by the Auctioneer. Sales taxes on the sales price are collected upon payment.  Dealer's sales tax exemptions will be recognized only upon providing a proper, current resale tax identification upon registering for a bid card at each auction.  If sales tax has been collected, we will not refund sales taxes even if a valid number is subsequently provided. All purchases made In-Person must be paid for on the day of the Auction. All Absentee and Phone Bid purchases must be paid for within 72 hours of the Auction.  We will accept cash, Master card, Visa, and Discover and Wire Transfer.  We will accept personal checks with proper identification, but we charge, and Buyer must pay the maximum fine allowed by state law for returned "NSF" check.  All out of state buyers must have Bank Letter of Credit or have payment approved by Auctioneer, no merchandise will be removed from Auction premises until funds have been guaranteed.  We do not provide storing, packing, loading, or transporting services.       5a.  Loading:  Purchases may be removed from the premises of the day of the sale or pick up during the week during normal business hours. Buyer must have a paid purchase receipt to obtain items. Hal Hunt Auctions nor any of its employees shall not be responsible in any manner for any type of damages caused, as a whole or in part, by the packing, loading or transporting of any item once it has been purchased by Buyer. Buyer may negotiate private agreements with our employees to assist him in removing his purchases this agreement shall be performed under Buyer's exclusive supervision and at Buyer's sole risk.
